Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Putt4Dough website at putt4dough.vercel.app and the related software (collectively, the "Service") provided by JP Copeland ("we", "us", "Putt4Dough"). By using the Service, you agree to these Terms. If you don't agree, don't use the Service.

1. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account. If you are below that age, you may use the Service only with the involvement of a parent or legal guardian who agrees to these Terms on your behalf. We do not knowingly accept users under 13.
2. Accounts
You're responsible for keeping your account credentials secure. You're responsible for everything that happens under your account, whether or not authorised by you, except to the extent caused by our breach of these Terms. Notify us immediately at jp@dataonthespot.com if you suspect unauthorised use.
You may have one personal account. Sharing accounts is prohibited.
3. The Pro purchase
3.1 What Pro is
Pro is a one-time purchase that grants you access to the Pro features of the Service for 365 days from the date of purchase. The current Pro feature set is described on the upgrade page within the Service. After 365 days, your account automatically reverts to the Free tier. Pro does not auto-renew.
3.2 Price
The current price of Pro is $89 USD. We may change pricing at any time, but the price you pay for a one-year access window is the price in effect at the time of your purchase. Changes apply to subsequent purchases, not retroactively.
3.3 Refunds
We offer a 14-day money-back window after purchase, no questions asked, provided you have not used Pro features extensively (more than 50 putts) during that period. To request a refund, email jp@dataonthespot.com with your purchase confirmation email. Refunds are issued via Stripe to the original payment method.
After the refund window closes, all sales are final.
3.4 Renewal
When your 365-day access window ends, your account drops to Free. You may purchase another year at any time at the then-current price. We may, at our option, offer existing customers a renewal discount for a major version update.
3.5 Tax
Stripe handles applicable taxes at checkout where required. The price you see at Checkout is the price you pay; tax may be added at the next step depending on your location.
4. Acceptable use
When you use the Service, you agree NOT to:
- Reverse-engineer, decompile, or attempt to extract source code from the closed-source components.
- Resell, sublicense, or redistribute access to your account or to Pro features.
- Use automated tools to inflate your stats or leaderboard rankings.
- Submit putt data that you did not actually generate (e.g., scripted submissions).
- Use the Service to harass, defame, or harm others.
- Attempt to disrupt or compromise the Service's availability or security.
- Violate any applicable law or regulation.
We reserve the right to suspend or terminate accounts that violate these rules, with or without notice depending on severity.
5. The leaderboard
If you opt in, your display name and aggregated putt statistics will be publicly visible on the Service's leaderboard. By opting in, you grant us a license to display this information publicly for as long as you remain opted in. You can opt out at any time, after which your name will not appear on subsequent leaderboard reads, though it may still appear in cached pages or third-party screenshots taken during the period you were opted in.
You're responsible for the display name you choose. Don't use a name that infringes someone else's trademark, contains slurs or obscenity, or otherwise violates these Terms or applicable law. We may rename or remove inappropriate display names at our discretion.
6. Local software
The Putt4Dough tracker software (a Python program plus a launcher) runs on your computer. We provide it AS IS; you install and run it at your own risk. We don't access your computer remotely.
All of the local software is our copyrighted work. We grant you a license to install and use it for your personal practice in connection with the Service. You may not redistribute, sell, or sublicense it without our written permission. If portions of the local software are released under an open-source license, that license governs those portions and is included in the distribution.
7. Intellectual property
We retain all right, title, and interest in the Service, including the website, the API, the brand, the artwork (scenes, icons, sounds), and our software components. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial use.
You retain ownership of any data you submit to the Service. By using the Service, you grant us the licenses described in our Privacy Policy to operate the Service.
If you provide feedback or suggestions about the Service, you agree we may use them without compensation or attribution.
8. Third-party services
The Service relies on third-party services including Clerk (authentication), Stripe (payments), Vercel (hosting), and Fly.io (hosting). Their separate terms and policies govern your interactions with them.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR ACCURATE. WE DO NOT WARRANT THAT YOUR USE OF THE SERVICE WILL IMPROVE YOUR PUTTING.
Some jurisdictions do not allow the exclusion of certain warranties, so these exclusions may not apply to you in full.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR YOUR USE OF THE SERVICE WILL NOT EXCEED THE GREATER OF (A) $89 USD OR (B) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM.
These limitations apply even if a stated remedy fails of its essential purpose. Some jurisdictions don't allow these limitations, so they may not apply to you in full.
11. Indemnification
You agree to defend, indemnify, and hold us harmless from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of (a) your use of the Service in violation of these Terms, (b) your violation of any law or third-party right, or (c) any putt data, display name, or other content you submit to the Service.
12. Termination
You may stop using the Service at any time and delete your account by emailing jp@dataonthespot.com (or via the in-app Delete-my-account button on the Account page). We may suspend or terminate your access to the Service for material breach of these Terms; if we do so without cause, you may request a prorated refund of any remaining Pro access.
Provisions of these Terms that by their nature should survive termination (including § 7, § 9–11, and § 13) will survive.
13. Governing law and disputes
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. You and we agree that any dispute arising out of these Terms or the Service will be resolved exclusively in the state or federal courts of Travis County, Texas, and you consent to personal jurisdiction in those courts.
If you are a consumer in a jurisdiction whose mandatory consumer-protection laws give you the right to bring claims locally, this section does not override that right.
14. Changes
We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top. Material changes will be communicated by email to registered users or via a notice on the Service. Continued use after the effective date constitutes acceptance.
15. Miscellaneous
- Entire agreement: these Terms and the Privacy Policy are the entire agreement between you and us regarding the Service.
- Severability: if any provision is unenforceable, the rest remains in effect.
- No waiver: our failure to enforce a provision is not a waiver of our right to do so later.
- Assignment: you may not assign these Terms; we may assign them in connection with a merger or sale.
- Notice: legal notices to us must be sent to jp@dataonthespot.com.
